Terms of sale

1. Who you are buying from

The seller is FLOFUM, S.L., a Spanish limited company whose registered office is Calle Parcerisa 13, Local 1, 08014 Barcelona (CIF B75621250). Flarnex is the name it trades under for garden tools. Questions go to support@flarnex.com.

2. The website is a catalogue

You can browse the range and order from the basket, and the contract is formed on the telephone rather than on the site itself — there is no cart and nowhere to enter payment details. The price shown next to each tool is the price you pay, and the total we confirm to you in writing is simply those prices added together.

3. When we have a deal

A request from you is not an order, and it does not bind either of us. Our emailed total is the offer. The agreement exists from the moment you accept that total in writing.

We are entitled to turn a request down — a tool may have sold out, or the address may fall outside our delivery zone. If that happens you have lost nothing.

4. What the price covers

Our total bundles together the tool, Spanish VAT and carriage to your door, and stays fixed once sent. If we change a price on the website, a request you have already made keeps the price that was shown when you made it.

Should a listed price contain an obvious error, such as a misplaced decimal point, we are not obliged to honour it — and we will raise it with you before dispatch, never after.

5. Payment

Payment is in cash, handed to the courier on delivery, in the currency of the destination country. There is no other method and no deposit, ever. Until the parcel is in your hands, you owe us nothing.

6. Delivery and risk

Carriage to street addresses within the EU is part of the total. The timings on the delivery page are genuine estimates rather than promises. Once you have paid the courier and taken the parcel, the goods are yours and so is the risk of loss or damage.

7. Changing your mind

Up to dispatch, cancelling is free. On the doorstep, you can decline the parcel for any reason and pay nothing. After it arrives, you have 14 days to tell us you are withdrawing, without giving a reason, and a further 14 days to send it back. See the returns page for how.

8. Guarantee

Each tool comes with the legal guarantee of conformity, which Spanish law sets at three years from delivery, explained on the warranty page. Nothing in these terms narrows the rights you have as a consumer.

9. Safe use

Please follow the manual supplied with every tool, particularly the maximum branch thickness for cutting tools and the heat warnings for the weed burner. We cannot accept responsibility for harm that results from using a tool for a job it was never designed to do, or in a way its instructions warn against.

10. Limits on our liability

If we break these terms or act carelessly, we compensate you for losses that were a foreseeable result. The law does not let us exclude liability for death or injury caused by our negligence, or for fraud, and we do not attempt to.

11. Governing law

Spanish law applies to these terms. Disputes may be heard by the Barcelona courts, though as a consumer you can also go to the courts in your own country. Writing to us first normally resolves things fastest; after that, your national consumer authority, or the European Consumer Centre in your country for a cross-border purchase, can help.

12. If these terms change

We may revise these terms over time. Your order is governed by whichever version was live on the day you accepted our total, and we keep older versions archived so that can always be checked.
